In the Order of Citation for Contempt, Supreme Court Case SC 06-07, the Supreme Court ruled: “A hearing on the issue of contempt was held before the full Supreme Court at the Tribal Mound Complex on July 18, 2007. Before the hearing, this Court ruled on two motions filed by the Defendant National Council on the 18th of July, hours before the scheduled hearing. Both Motions were denied and the Court reiterated that legislation passed by the National Council in an attempt to intimidate or harass this Court was unconstitutional and a further infringement on the separation of powers doctrine. “
Also in SC 06-07: “The Court refers the parties back to our opening statements on July 18, 2007 where we found unconstitutional NCA 07-167, which is legislation passed by the National Council providing for, among other things, the imprisonment of the members of the Supreme Court should they ever find any officer of the Muscogee (Creek) Nation to be in contempt.” The Court added, “The members of the National Council are, in fact, officers of the Muscogee (Creek) Nation.”
It would be helpful too, if you could do the same with the OPINION AND ORDER OF CITATION FOR CONTEMPT, Supreme Court Case No. SC 06-07 (renumbered from SC 2005-03)
Of interest is that the National Council has been cited for contempt and cannot be cited again for contempt. Should the National Council again be found in Contempt of Court, a higher lever of punishment is required. Reply to this
