TRADE & COMMERCE BOARD - Lawsuit against Judge Moore & Chief Ellis in S. C.
NEXT COURT DATE FOR THIS CASE: 9:00AM - JUNE 4, 2010 (Friday). Last court date was 5/6/2010 and neither their Attorney Roger Wiley nor the Plaintiffs showed up for the hearing.
HENRY HARJO, DEAN HUGHES, BRETT THOMAS & RONNIE WEST have filed 2 Cases in the S. C. today, both against District Court Judge P. Moore and MCN Chief A. D. Ellis, in the MCN Supreme Court.
1. Application to Assume Original Jurisdiction, Petition for Writ of Prohibition and Application for Appointment of Special Judge.
2. Petitioners' Brief in Support of Application to Assume Original Jurisdiction, Petition for Writ of Prohibition and Application for Appointment of Special Judge.
********************************
THE MOST "TELLING" PART OF THESE FILINGS IS: THE T & C BOARD IS BEING REPRESENTED BY OUR INTREPID ATTORNEY GENERAL ROGER WILEY.
Is it legal for the A. G. (Judicial) to represent an "Independent Board" against the Chief (Executive) and Judge Moore (Judicial) ?
We will never know because Wiley has tainted his position and himself, to be tribally non-partisan AND to defend the MCN against others, which he has never done. We shouldn't be surprised that he has compromised himself, and is proving to be the attorney for the NC. He is a traitor.

Can't say I was surprised that our illustrious AG has taken on the cause of the Trade and Commerce Board. There were rumors that Wiley had been meeting with the board lately and in, of all places, the Speaker's Office. This tribe is at a standstill because of all the frivilous lawsuits being filed by our political and community thieves. Wiley would be better off chasing down all the thieves and filing criminal charges instead of civil lawsuits (which is the rumor)! I'm waiting for a call to action by anybody that wants to take back control of our Nation. Be it mass protests or physically taking over the complex, we're close to losing every thing if something is'nt done. Mvto!

Yeah I would like to see the citizens camp out and protest. Just like the big protest last time when only one citizen showed up. Now that was funny. Bring it on. I sure our tribal police have room for you

I’m not sure if there is enough room. Roger Barnett is a big fat guy and getting fatter, and George is not a small person, especially his head. And there’s you.

A citizen told me the other day that he had a crisp one-hundred dollar bill in his wallet that he was willing to bet against my twenty dollar bill that Roger Barnett is in deep doo-doo and will not last out his term of office. Roger Barnett pushed the envelop as far as he could believing that the laws the National Council have deviously crafted would always provide a way out. Roger and friends are banking on the fact that citizens have become so use to scandal going unpunished that they will not do anything. Well, surprise.
Roger and friends have no money to hire lawyers to defend them. Now they will take anyone, even Roger Wiley. But Wiley is easy and smart enough to know on which side his bread is buttered. He is putting all his marbles in the pocket of the National Council with confidence that they will take care of him in the bye and bye.
Wiley and Barnett are a good match and deserve each other.
Did I take the bet? Yes, and hoping like hell I lose.

District Court hearing on the Chief's original TEMPORARY RESTRAINING ORDER to the T & C Board will be on THURSDAY 5/6/10, 1:00PM at Mound court room.
We need to be there, if not to support the Chief, to express our opinions on those corrupt and greedy T & C Board and they need to be expelled from the Board. They do have some nerve - but then its only because they have the equally corrupt NC members and the A. G. on/by/at their side.
This is the time that we find out about WHO'S WHO, WHERE EVERYONE STANDS ON THIS ISSUE.

Neither the T & C Board, or their legal representative, showed up for the hearing today. Wonder if the AG has come to his senses and butted out from something he has no business sticking his nose in to. Wiley should be protecting the Creek Nation's best interests by pursuing criminal charges against the Trade and Commerce CEO instead of defending the T & C Board. But what do I know?
Reply to this
You mean even Wiley coyote didn't show up to defend his charges? You would think he would at least show up to relate to the court why his defendents were not present. You know how the story goes with those corrupt ones: They're working on something to throw at us citizens. They always do, so be ready. He has really pulled a boner representing the crooks against the Chief. I just can't understand why he did that.
Maybe his unethical activities should be reported to the OK Bar Assoc. (?), or be removed from the roster of attorneys licensed to practice in our courts. I would think a lack of ethics is a good reason to remove him.

The lawsuit brought on by the T & C Board was NOT their idea. The two (2) Rogers (Barnett & Wiley) encouraged them! Heck, the NC Speaker was even facilitating the meetings by allowing the AG and the T & C Board to meet in his office! Time to send both Rogers down the road.

This is pure unadulterated political meddling by of course persons with tainted backgrounds. Why in the world would any governmental official be it Principal Chief, Speaker, National Council Member or Attorney General want to obscure, cover up and try to deny the truth being brought out in a Court of Law. Well the answer is the Principal Chief has uncovered wrong doing, not of his making, taking executive action for the benefit of all Creek citizens and the governmental officials are doing their dead level best to obscure, cover up and prevent truth coming out in open Court. Why, well obviously those in the business of cover up and delay to prevent proper action are receiving something of value. What might that be - future job - present money - political power? Soon all will find out and there will be some people very sorry for their cover up actions.

This action was totally expected from Barnett. He has no sense of ethics.
As for the AG Wiley coyote, what got into him? If he was as bright as I had given him credit for, he would have had the T & C Board meeting at his office, not at the council offices. Stupid is as stupid does! Yes, time to send both Rogers down the road. They did not fool anyone. We knew what was going on whenever the AG was observed hopping down the NC trail.
The T & C Board is now pleading ignorance. Too late for that. Damage has already been done.

As the next step in for those litigants who didn't show, the trial has been set for:
JUNE 4, 2010 @ 9:00am at District Court. This case should be very interesting.

THE RUBBER WILL MEET THE ROAD ON JUNE 4, 2010 AT 9:00 AM IN OUR DISTRICT COURT ROOM. OUR LOYAL DISTRICT JUDGE WILL BEGIN SEPARATING WHEAT FROM CHAFF, PIGS FROM GOATS, TRUTH FROM FICTION AND THE CORRUPT WILL BE EXPOSED. THE COURTROOM SHOULD BE FILLED AND THE PRESS SHOULD TAKE PICTURES OF THOSE WHO TESTIFY AND ATTEMPT TO JUSTIFY THE LUDICROUS EXPENSES BY TRADE AND COMMERCE EXECUTIVES, BUT DO NOT BE SURPRISED IF NO ONE SHOWS UP AGAIN FOR THE CHIEF'S LAWYER HAS TURNED EVERY LAWYER AND WITNESS HE HAS FACED SO FAR INSIDE OUT AND THERE IS NO MONEY AVAILABLE FOR THE TRADE AND COMMERCE TO TAP INTO SO EXPECT EVERYONE TO TAKE A POWDER EVEN THE VACILLATING AG IF HE IS STILL RECEIVING A PAYCHECK.

I hear Wise ass is gone now it's time for the trade and corruption board to be gone also along with the deal makers on the council. They are all a big part of thoese self serving ones that are using the tribe for self gain.People if you don't stand up for what is right in support of the Nation you don't deserve a Nation.

Henry Harjo is a thief and the National Council were informed before he was appointed to that position. He was on the Economic Development Board with one of the Tribal Towns, and could not and would not account for monies to be used for Economic ventures. He, and Jennie Lillard, Beth Peterson and Josephine Anderson were all on that board. They used over $70,000 and have nothing documented but they got their stipends and trips. So he is being protected by the NC and the AG. Who on the National Council can answer this for me. If the Chief hadn't done the audit and removed them, who on the NC would have started the proceedings (Tiger, Ade Scott, Barnett, Yahola, Fife, Wind,or the AG. I don't think so, not when the packrats gather together to tear the Nation down and put theives before the tribe.

If Creek Nation is in the habit of electing and appointing thieves then Henry Harjo is your man. He will not only talk circles until he thinks you will believe him, but will line your pockets in hopes that you will believe him in future lies he will tell. Allowing Wisener to take all those trips and other benefits, was just his way to look out for his benefit in some aspect or another. Its probably to keep his spot on the Trade and Commerce Committee. Where there's money to be had, you can be sure he will be there. He will "volunteer" his time, but will look for a reimbursement later. If you look at the audit reports, you will notice a name "Andrew Long", and you will soon find out this person and Henry are kinfolks.

It has been rumored for a couple of years that the Wiley coyote was sleeping with the enemy. Now he has come out of the closet. He became the darling of those corrupt NC members back when the Supreme Court ruled against those members who had appointed themselves to the Constitution Commission. Remember them: Tiger, B. Fife, J. Fife, Cleghorn, LaGrone, Barnett, Pickering and Yahola. Judge Moore was also on that Commission. Then Wiley coyote wrote his memo (opinion) stating that it was the wrong decision, but that the court had made their decision. When the subsequent Commission was named, Moore was again appointed to represent the Judicial branch by the Supreme Court. That is part of the history. From then on, the corrupted NC members took him under their wings, and ole coyote became their collaborator.

What is interesting is that the A. G. Roger Wiley hasn't done one thing to see if those casino/community crooks should be prosecuted. There was plenty of information on them, yet Wiley hasn't done a single thing. We have many other names in the corruption bucket and Wiley hasn't done anything. Is it possible that he had something in the wind, so was he saving himself for another purpose?

One other point the Court should remember is that the Trade & Commerce Board did not have a quorum, after Wiesner appointed himself CEO. They only had 2 Board members. Without a quorum, how can they hold any meetings, or make decisions - and have them be legal? This is a fact. So I would say anything and everything they did and made decisions about are MOOT & VOID.

Attorney General's functions:
An attorney general is the top "law enforcement" officer in the Nation.
It is obvious that Wiley Coyote will not prosecute any king of corrupt activity.
It is obvious that Wiley Coyote is in partnership with those on the NC that are corrupt.
It is obvious that he should be terminated for not performing his duties. He is a crook too.
Watch him at any meeting he attends.
He won't look at people that are honest - only rushes buy to get with the corrupt pack of thieves that sit on the NC.
What has to happen to the Nation before we gather as a people and stop this insanity.
The National Council protects anyone that is corrupt, the AG protects anyone that is corrupt with the blessing of the National Council.

Roadrunner always wins in the end. The result will be the same in this case. Wiley Coyote should spend some time working on his resume. Remember Wiley Coyote when you lay down with dogs you get fleas.

One of the T & C Board members (H. Harjo) flew the coop. He has resigned. I wonder what brought that on. Could it be that he can see the real light, and it wasn't shining on them. Maybe there's truth to all that garbage we read about and they (NC) tried to pull the wool over our eyes.

What about Edwin Marshall getting the Chief of Staff position? Wasn't he caugth doing something that he shouldn't of been doing?
Reply to this
Is this true about Edwin Marshall? Not knowing too much about him, from what I do know, he is fairly knowledgeable about Creek laws and customs. But I have always been leery about his background. Can a TIGER change his stripes? This is a wait & see situation.
Reply to this
It is believed that Marshall is NOT a thief.
Hope he doesn't start working with those corrupt NC reps from his area. If he does what is right and doesn't get in with them he should be okay.
One thing was the fling -
and quitting the NC seat for a job. That was when NC seats paid $800.00 a month. Guess he had to feed his family. Can't hold that against him.

Why do we as a people fight over money and power when we have elders and children, men and women going hungery and unmedicated. Yes we have Dr's and hospitals \ clinics, but we could do better. We have food programs but still we could do better. We should be better, financially diversified so we can grow more independent of others. We are a PROUD PEOPLE, a GREAT PEOPLE but why is it we can not forgive each other or ourselves at times when we need to be our strongest. The world is in bad shape and we are getting no better. Our Laws are not strong enough or plain enough, there seems to be enough slack or loop holes for both sides to sue each other and waist more money that could be spent on needy citizens or new business opportunities. PLEASE STOP FIGHTING FOR THE SAKE OF THE NATION!
All three branches of the Government should be equal in power, or it will never work right. All Judges should be elected just as the other two branches. Then there should be no favortisum between two branches. I am proud to be a member of the Muscogee Creek Nation, and I ask respectfully of our leaders in all branches, PLEASE if you can't work it out without a law suit ask the other tribes for a non partisan panel to meditate for the two branches in dispute until new and stronger constitutional laws can be drafted.
Thank You For Your Time.....

Judge Moore Grants Permanent Injunction
After allowing for an extension of time for petitioners to prepare their case, and in what some anticipated would be a knockdown and drag out fight between lawyers representing the Principle Chief and the Board of The Trade and Commerce Authority, ended in barely a whimper today in the Muscogee District Court.
After hearing arguments between Attorney General, Roger Willy representing The Trade and Commerce Authority, and Attorney’s for the Principal Chief, Judge Moore, in a move that surprised many, granted a permanent injunction from the bench.
Moore, addressing the Attorney General said his argument was not “germane” to the issues being argued in the court. Before issuing a decision, Judge Moore expressed frustration of being “tired” of hearing the same complaints and “wondered” if was possible to prosecute people who continually break the law.
One witness from the forensic audit team hired to perform the Trade and Commerce Authority audit was called to testify. The courtroom session lasted two hours in front of a sparse gathering of citizens.

Yes, AG Roger Wiley was there, but none of the board he was representing. But Henry Harjo had already resigned. Wonder why the others didn't show up. You would think they would want to offer their sides of the lawsuit, and how they did or did not assist Wiesner in all those 'sexual excapades' which were brought up in court. Yes, Bill Fife & your bunch, your boy is a sordid character. That is what you are all protecting. Has Della Cherry and George Tiger met to discuss any business? It would be interesting as to how ole George will present himself. He and Della hate each other from what I've heard.

Thank you Judge Moore for halting this wasteful council supported operation. A look at the investments and waste of Creek money by Trade & Commerce is despicable. Buying river bank in Tulsa for a Toll bridge? Investing in Chinese Internet Had the Judge allowed this to continue I wouldn't have been surprised to see Trade & Commerce buy beach front property at Louisiana's Barateria Island for OIL Speculation.

I have seen & heard that 6/4/10 hearing on the MCN website. I had already read the audit report so that didn't surprise me. It was no surprise what Wiesner did do, but to use the tribal credit cards for his sexual escapades, wasting money on trips, losing our money to China, Haiti - now those are the kinds of things that brought the Chief to the firings which the Council finds objectionable. All of a sudden, they holler that they would have taken care of the matters if only they knew about the T & C doings. They knew. Don't believe for a second they didn't. It doesn't take a brain to have seen what was going on. They also say that the NC makes it a point to stay our of the Independent Boards' business. Do you believe that? That's the only thing they're interested in - meddling.
What is interesting are the comments from Wiley coyote, responding to Judge Moore's question as to Wiley's authority to represent a Board and to sue the Chief. Also, most interesting are his closing comments, which were so lame. He repeated he was not protesting audit reports and behavior of the Board, but only the Chief's process of how the Board was summarily 'fired', when there are legal ways to do it. He would much rather have the board's dismissal case go to the NC - again where nothing would happen and they could continue to do their corrupt acts while any actions were stalled by Roger, Fife and bunch. Wiley said 2 wrongs don't make a right. How about hundreds of thousands of dollars mishandled or misappropriated by the Board & Wiesner? I think that amounts to more than 2 wrongs by itself.
I will still hold on to the thought that it is not legal or ethical for the coyote to represent a tribal board against the Chief. The Chief appointed Wiley, so he should terminate him, NOW. Would he do the same thing and rep a Board against the NC. NO NO NO.

We need a Fus Fixico writer today,
Wiley would have the Indian name 'ole yellowbelly', the name would represent his cowardliness and inconsistency to prosecute white collar crimes in Creek country. This man should resign asap. I watch de ole film from the court, he claims no proper channel was followed by the Chief to get rid of the Weasel and the sleeping board even though they been stealing fo years right under Yellowbelly's nose. Yellowbelly resign please. And how many times de ole Chief had to sue to stop the pack rats from breaking the constitution when ole Yellowbelly just looked the other way. Ole Yellowbelly, just plain see nothin, hear nothin and done nothin. Give a nu name to AG, now means attorney goodfonothin.

Here are a few lawsuits Wiley should be bringing to the courts instead of suing the Chief and Judge Moore - for a Board!
1. Tom Pickering & McIntosh District members, Daniel Wind, Jeff Fife and other Duck Creek members, Checotah casino & Community members; among others, to get our Tribal money back.
2. Prosecute Michael Weisner and the T & C Board, and get our tribal money back.
3. Take Roger Barnett to court for not residing in the district he represents.
4. Dana Johnson, Tax Commissioner, for illegal actions, and get our tribal money back.
There are others he can prosecute, but he won't because he is afraid to ruffle anyone's feathers, afraid of the NC, afraid he might lose his job, and he still thinks the Chief will appoint him to be Judge of our District Court. Imagine that! I have not heard of one case where he has taken anyone to court except for this most recent one about the T & C Board. And then, he ends up suing Chief Ellis and Judge Moore. What are his priorities. I think I have answered my own question.

Wiley hides behind a skirt - he has told many Creeks that he does not prosecute, the Nation has a prosecutor that he can not meddle with - baloney - Wiley hires and fires all Assistant Attorneys General. The AG is guilty of not doing the job and should do as in an old Army cliché "Shape up or Ship out"

I forgot about Wiley's other possible lawsuit. It has been said that he will be prosecuting 2 female elders from the Okmulgee Community. Is this easy pickings for him? I don't know that the charges may be, but they must be up there along with the Trade & Commerce Board to get his attention and decide he had better go after the women.

It's to bad Judge Moore couldn't be the attorney general and make cases against crooks and you know who they are.
